The seller operates a physical shop in Teplice and an online shop selling bikes, components, cycling accessories and clothing from Specialized, Kellys, Kross, Author and other brands, through both direct purchases in the online shop and through star auctions for selected bikes.
These terms form part of the sales contract. Contracts can be concluded in the languages offered by the shop’s language selector. These terms apply to consumers. Business purchases are governed by the applicable provisions of the Civil Code.
The seller may amend or supplement these terms. The parties’ rights and obligations are always governed by the version in force when those rights and obligations arose.
2. Definitions
- —Shop — the online shop HPM Sport operated by the seller.
- —Goods — bikes, components, cycling accessories, clothing and other products offered in the online shop.
- —Buyer — a natural person (consumer) or legal entity concluding a purchase contract through the online shop.
- —Consumer — a buyer concluding a purchase contract with the seller outside the scope of their business activity (Section 419 of the Civil Code).
- —Buy directly — a standard purchase of goods at a fixed price through the online shop’s cart and checkout.
- —Preorder — a special form of direct purchase for selected models that are not physically in stock when ordered; the buyer reserves an allocation with the supplier and pays the purchase price in advance.
- —Star auction — a special sale format for selected bikes with a dynamic price (Falling / Frozen / Battle phases).
3. Direct purchases in the online shop
Most goods in the online shop are offered at a fixed price. These goods can be purchased by adding them to the cart and completing an order at checkout.
3.1 Ordering process
- 1.The buyer selects goods and adds them to the cart using the “Add to cart” button.
- 2.At checkout, the buyer enters contact details and a delivery address and selects a delivery method.
- 3.The buyer checks the order summary, including the total price, and confirms the order using the “Place order with obligation to pay” button.
- 4.Before confirming, the buyer must read these terms and confirm agreement to them.
3.2 Formation of the purchase contract
All product presentations in the online shop are for information only, and the seller is not obliged to conclude a purchase contract for those goods. Section 1732(2) of the Civil Code does not apply.
The purchase contract is formed when the seller’s order confirmation (acceptance) is delivered to the buyer’s email address. An automatically generated acknowledgement of receipt of the order does not constitute acceptance.
Depending on the nature of the order, including the quantity, purchase price and estimated delivery costs, the seller may request additional confirmation from the buyer.
3.3 Availability of goods
The label “In stock” means the goods are available in the seller’s or supplier’s warehouse at the time they are displayed. Availability may change between viewing the product and completing the order. If goods are unavailable after an order is received, the seller will inform the buyer without undue delay and propose a solution, such as waiting for restocking, a refund or an alternative product.
3.4 Preorders
For selected bike models not yet physically in stock, typically current-season models from premium brands and selected suppliers, the seller allows a preorder. A preorder is a binding reservation of a supplier allocation, with an obligation to pay the purchase price in advance. Preorder products are clearly identified, for example by a “Preorder” button, a preorder availability label and an estimated delivery date.
The delivery date shown for a preorder is an estimate. The actual date depends on the manufacturer’s and supplier’s production and logistics schedules and may change. In the event of a significant delay compared with the original estimate, the seller will inform the buyer without undue delay. The buyer may withdraw from the purchase contract, in which case the seller will refund the purchase price without undue delay and no later than 14 days after notice of withdrawal.
Price shown for a preorder is valid when the buyer confirms the order and will not be increased unilaterally by the seller after acceptance. If the manufacturer changes part of the technical specification during the season, for example to an equivalent or higher-level component, the seller will inform the buyer in advance. If the buyer does not agree, they may withdraw from the contract and the seller will refund the purchase price without undue delay.
Cancellation of a preorder by the buyer. The buyer may cancel a preorder at any time before dispatch. The seller will refund the purchase price without undue delay, no later than 14 days after receiving the cancellation request. This does not affect the consumer buyer’s statutory right to withdraw within 14 days of receiving the goods under Article 8 below.
Acceptance of a preorder. The preorder purchase contract is formed when the seller’s order confirmation (acceptance) is delivered to the buyer by email. The seller reserves the right to decline or not confirm a preorder if the supplier allocation is no longer available or the supplier discontinues the model without a replacement. In that event, no purchase contract is formed and the seller will return any payment without undue delay.
4. Star auctions for selected bikes
Selected bikes may be offered through star auctions. These products clearly display the current auction price, auction phase and “Win auction” button. Unlike a conventional auction, a star auction allows the price to fall:
- —Each auction product starts at an opening price corresponding to the manufacturer’s recommended retail price (MSRP) or another initial price set by the seller and displayed with the product.
- —During the Falling phase, the price decreases automatically at regular intervals by a predetermined amount.
- —During the Frozen phase, the price stops decreasing.
- —If demand increases, the auction may enter the Battle phase, where the price may temporarily increase in response to buyer activity.
- —Each auction product is offered in the limited quantity shown. The goods are purchased by the first buyer who successfully completes the order at the current auction price.
The applicable price is the price displayed on the product page when the buyer confirms the order. Auction purchases follow a process similar to direct purchases under Article 3.1, except the “Win auction” button starts checkout directly at the current auction price. The purchase contract is formed upon the seller’s acceptance under Article 3.2.
The seller may end, suspend or change an auction’s parameters early; this does not affect orders already confirmed.
5. Prices
All prices displayed in the online shop include value added tax and all related charges, except shipping where applicable (see Article 7). The price displayed when the buyer confirms the order applies and cannot subsequently be changed by either party after the order is completed.
Discounts offered by the seller cannot be combined unless the specific promotion expressly states otherwise.
6. Payment terms
The buyer pays the purchase price to the seller by bank transfer to the seller’s account (Article 6.1) or, where offered for the specific order, by online payment with a card or PayPal (Article 6.2). Star auction orders and preorders can only be paid by bank transfer.
6.1 Bank transfer
For payment by bank transfer, the buyer uses the following payment details:
- —Account number: 107-3729690257/0100
- —Bank: Komerční banka
- —IBAN: CZ0901000001073729690257 · BIC/SWIFT: KOMBCZPPXXX
- —Payment reference: shown in the order summary and payment details email.
For the buyer’s convenience, the order summary and payment details email include a QR code in SPAYD format (Czech QR payment). Scanning it in a mobile banking app prefills the bank transfer details.
6.2 Online payment by card or PayPal
For direct purchases in the online shop, the seller may offer online payment through the Stripe payment gateway, provided by Stripe Payments Europe, Limited, with its registered office in Ireland. The buyer can pay by payment card or, where they are offered on the payment page and supported by the buyer’s device, with Apple Pay or Google Pay, and, where offered for the order, also with PayPal. The available payment methods are shown on the payment page.
Online payment is only available where it is offered for the specific order; in that case, a button for online payment is shown to the buyer after the order is placed and on the order page. Online payment is not offered for star auction orders or preorders.
Payment takes place on Stripe’s secure payment page, to which the buyer is redirected. The buyer enters card details only on that page; when paying with Apple Pay, Google Pay or PayPal, the buyer confirms the payment in the respective service. The seller neither receives nor stores the full card number or security code. Payment is made in the order currency (CZK or EUR) for the total order price. The seller does not charge any fee for online payment; any currency conversion or other fees charged by the card issuer or PayPal are governed by the agreement between the buyer and that provider.
The same payment deadline applies to online payment as to bank transfer (Article 6.3). For online payment, the purchase price is paid when the payment service provider confirms to the seller that the payment was successful. If an online payment is not successful, the order remains unpaid and the buyer may pay it by another offered method before the payment deadline. If the buyer pays the same order more than once by mistake, the seller will refund the overpayment without undue delay.
Refunds. Where the seller refunds money received by online payment (for example after withdrawal from the contract, cancellation of the order or settlement of a complaint), the refund is made to the payment method used (payment card or PayPal account). If that is not possible (for example because the card has been cancelled or the period in which the payment provider allows refunds to the original payment method has expired), or if the seller and the buyer so agree, the refund is made by bank transfer to an account designated by the buyer, at no additional cost to the buyer. The seller initiates the refund without undue delay; the time it takes for the refunded amount to be credited depends on the card issuer or PayPal.
6.3 Due date and documents
After the order is placed, the buyer receives an email confirmation with payment details and, where applicable, a proforma invoice. The purchase price is due by the due date stated on the order page or in the confirmation email (usually 72 hours after the order is placed); this period applies to all payment methods. If the purchase price is not paid within this period (for bank transfer, by being credited to the seller’s account; for online payment, by confirmation of the payment under Article 6.2), the seller may withdraw from the contract. An auction order is cancelled and the goods may return to auction.
Once payment is received, an electronic tax invoice is issued and sent to the buyer. The seller may require full payment before dispatch.
Preorders. For preorders under Article 3.4, full advance payment against a proforma invoice is required to confirm the supplier allocation. If the buyer does not pay by the due date, the seller cancels the preorder and releases the allocation to other buyers.
7. Delivery terms
The buyer selects a delivery method when ordering from the following options:
- —PPL — delivery to an address
- —DPD — delivery to an address or collection point
- —Balíkovna — delivery to a Balíkovna collection point
- —Collection in person — at our physical shop Alejní 2, 415 01 Teplice, Česká republika, by prior arrangement
Delivery charges within the Czech Republic. Collection in person is always free. All other delivery methods are free if the price of the goods in the order is at least 1,500 CZK; if the price of the goods is lower, delivery costs 99 CZK for each of them.
The price of the goods means the total price of the goods in the order including VAT, after any discounts applied and excluding delivery. Delivery prices include VAT. The delivery price is shown at checkout for each delivery method before the order is confirmed and is stated in the order summary. Delivery within the Czech Republic is free for purchases in a star auction.
The seller prices delivery to other European Union countries individually according to the parcel and the address. The buyer receives the delivery price in a quote, and the order is created only after the buyer accepts the quote with the final price.
Goods are usually dispatched within 2 working days of payment of the purchase price (for bank transfer, from when the payment reaches the seller’s account; for online payment, from when the payment service provider confirms it). Actual delivery times depend on the selected carrier and current product availability.
Preorders. Preordered goods under Article 3.4 are dispatched according to the estimate shown with the product, usually after the allocation arrives from the manufacturer or supplier and the bike has been professionally assembled at the shop. The two-working-day period after payment does not apply to preorders; the supplier’s allocation delivery date determines timing and may be updated for the buyer.
We recommend checking on delivery integrity of the packaging. If the packaging is damaged, you may refuse delivery or record the damage with the carrier. Please notify us as soon as possible. Not inspecting the parcel or obtaining a carrier report does not limit your statutory rights against the seller.
Where the seller must deliver goods to the location specified in the order, the buyer must accept them on delivery. If the buyer refuses delivery without a serious reason, the seller may charge for repeat delivery or withdraw from the contract.
Professional assembly. We dispatch bikes fully assembled and after final checks of the gears, brakes, wheels and frame. For more information, see Safe shopping.
8. Withdrawal from the purchase contract
Under Section 1829(1) of the Civil Code, a consumer buyer has the right to withdraw without giving a reason within 14 days of receiving the goods.
Notice of withdrawal must be sent to the seller within the stated period. The buyer may use a model withdrawal form but is not obliged to do so.
Preorders. For preordered goods under Article 3.4, the statutory 14-day withdrawal period begins on the date the goods are physically received, not the order or payment date. To cancel before dispatch, follow the preorder cancellation procedure in Article 3.4. This does not affect the right to withdraw within 14 days of receipt, which also applies after delivery of the bike.
Procedure:
- 1.Send notice of withdrawal by email to info@hpmsport.cz — include the order number and, if you paid by bank transfer, the account number (IBAN) for the refund.
- 2.Return the goods undamaged, preferably in the original packaging, to our physical shop at: Alejní 2, 415 01 Teplice, Česká republika, within 14 days of withdrawal.
If the buyer withdraws, the seller will return all payments, including the purchase price and the cheapest offered delivery method, without undue delay and no later than 14 days after withdrawal, using the same means of payment that the buyer used: a bank transfer is refunded by bank transfer to the buyer’s account, and an online payment is refunded to the original payment card or PayPal account. Another means of refund is used only if the buyer agrees and incurs no additional costs as a result. The seller need not refund before the goods are returned or the buyer proves that they have been sent back.
Return shipping costs The buyer pays the direct return costs. Consumers are only liable for diminished value caused by handling beyond what is needed to establish the nature, characteristics and functioning of the goods. Opening the packaging alone does not remove the right to withdraw.
Exceptions. The consumer buyer acknowledges that Section 1837 of the Civil Code excludes withdrawal in certain cases, including goods made to the buyer’s specifications or personalised goods, such as custom products or individual bike modifications.
9. Warranty and rights relating to defective performance
9.1 Statutory warranty
Rights and obligations relating to defective performance are governed by applicable law, in particular Sections 1914–1925, 2099–2117 and 2161–2174b of the Civil Code and Act No. 634/1992 Coll., on Consumer Protection.
The seller is responsible to the consumer buyer for goods being free from defects on receipt. If a defect appears within 12 months of receipt, it is presumed to have existed on receipt unless the nature of the goods or defect rules this out. The consumer buyer may assert rights arising from a defect in consumer goods that occurs within 24 months of receipt.
9.2 Extended manufacturer warranty
In addition to the statutory warranty, individual manufacturers may provide extended warranties for the original owner. Their terms and coverage are determined by the manufacturer and apply after registration in accordance with its rules.
Specialized
Lifetime warranty on Specialized / Roval frames and wheelsets for the original owner. Terms: specialized.com/cz/cs/warranty.
Kellys, Kross, Author and other brands
Manufacturer warranty according to the brand’s current terms — usually 24 months on components, with an extended frame warranty depending on the model. Details are available on request or when collecting the bike.
9.3 Warranty exclusions
The warranty does not cover normal wear, such as brake pads, tyres, chains, cassettes, cables and housings, or defects caused by improper handling, inadequate maintenance, mechanical damage, unqualified servicing or modifications, or racing and jumping beyond the product’s intended use.
9.4 Making a warranty claim
You can make a warranty claim:
- —In writing by email to info@hpmsport.cz
- —For servicing and technical faults: Milan Jirásek — MilanJir@seznam.cz, phone +420 603 384 878
- —In person at the physical shop Alejní 2, 415 01 Teplice, Česká republika
The seller will decide on a consumer claim immediately or, in complex cases, within three working days. This excludes a reasonable period needed for expert assessment of the defect. The claim, including rectification, must be resolved within 30 days of being made, unless a longer period is agreed with the buyer.
10. Personal data protection
The buyer’s personal data is protected in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 110/2019 Coll., on Personal Data Processing. Details are provided in the separate document Privacy policy.
11. Out-of-court dispute resolution
The body competent to resolve consumer disputes arising from the purchase contract out of court is the Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, registration number 000 20 869, website adr.coi.cz. The European directory of consumer dispute resolution bodies is available at the EU dispute resolution directory.
Court jurisdiction is determined by applicable law. Choosing Czech law does not remove mandatory consumer protection under the law of the consumer’s country of habitual residence.
The seller is authorised to sell goods under a trade licence. The competent trade licensing authority supervises trade activities. The Office for Personal Data Protection supervises data protection. The Czech Trade Inspection Authority supervises compliance with Act No. 634/1992 Coll., on Consumer Protection, within its statutory powers.
12. Final provisions
If the purchase contract involves an international element, the parties agree that it is governed by Czech law. This does not affect consumer rights arising under mandatory legal provisions.
If any provision is invalid or ineffective, or becomes so, it is replaced by a provision whose purpose is as close as possible to the original. This does not affect the validity or effectiveness of the remaining provisions.
The seller archives the purchase contract and these terms electronically. They are not accessible to third parties.
Seller’s contact details: email info@hpmsport.cz, phone +420 776 460 285, address Alejní 2, 415 01 Teplice, Česká republika.
These terms are valid and effective from 21 October 2026 and replace all previous versions.
